The Federal Board of Revenue (FBR) recently designed a new procedure as a measure for the automated unblocking of the mobile phone SIM card for taxpayers who file their income tax returns. This is part of the efforts to streamline the process and ensure telecom companies follow the rules set up by the FBR.
How It Works:
The FBR will send automatically the list of tax filers to telecom companies, and mobile SIMs will be unblocked without any action required by the taxpayer.
SIM Reactivation: Telecom companies will reactivate the service within 1 to 2 business days after receiving the list.
In case services are not resumed: If the individual has filed his income tax return, but after 3 working days, the mobile service has not yet been resumption, then an objection should be lodged with the relevant tax officer. The cause of action would be inquired and outcome would be informed to the taxpayer.
Process:
Thus, the FBR shall identify the non-filers based on the tax record and send the list for examination to the concerned tax authority.
Verification of Notices: The field offices shall verify whether all the pertinent notices have been issued and whether all the legal conditions for the year are present.
Issuance of Certificates: Chief Commissioners shall affirm and issue certificates stating that a person is a non-filer.
Income Tax General Order (ITGO): FBR will issue ITGO, which will order Telecom companies to unblock the SIMs of tax filers immediately.
Compliance: The telecom operators would also have to obey the orders. A compliance report submitted to the FBR within a due course would be expected from them.
Non-Compliance: If the telecom companies fail to comply with the orders, the FBR will take other legal actions. These may include penalties or even legal proceedings under the Income Tax Ordinance, 2001.
Monitoring: The FBR will monitor these enforcement orders and ensure to provide positive updates regarding the procedure as everything works out well.
