SHC Grants Release of Elegant Traders’ Goods Upon Payment of Duty, Taxes, Fine, and Penalty

KARACHI: The Sindh High Court (SHC) has granted a petition by Elegant Traders, allowing the release of their imported goods after payment of duty, taxes, and securing the fine and penalty amount. The decision came after the petitioner company agreed to settle the charges before the Nazir of SHC.

Elegant Traders, represented by the well-known law firm Franklin Law Associates, had challenged an order issued by the Collector Adjudication, which had instructed the confiscation of their imported goods for mis-declaration. The petition contested the Collector’s ruling made on August 29, 2025, which had offered the option to redeem the goods upon payment of the fine and penalty.

In the constitutional petition, Franklin Law Associates confirmed the petitioner’s willingness to pay the due taxes and duty, as well as to secure the fine and penalty amount before the Nazir of SHC.

Agha Shahid Majeed Khan, representing the customs department, opposed the petition, insisting that the full payment of all duties, taxes, fines, and penalties be made directly to the department. However, after hearing both sides, the SHC bench ruled in favor of Elegant Traders, allowing the release of their goods upon payment of all required charges.
