    SHC Adjourns Hearing on Cosmix Engineering’s Lawsuit Against Pakistan Customs

    KARACHI: The Sindh High Court (SHC) has postponed the hearing of a lawsuit filed by Cosmix Engineering against Pakistan Customs, Appraisement, West (AIB / R&D) for two weeks. A single judge asked the company’s lawyer, Mr. Shahab Imam, to clarify why the case should be accepted in court.

    Earlier, Sardar Zafar Hussain, the lawyer for the Customs department, told the court that a Show Cause notice had been issued to the plaintiff. He argued that the plaintiff’s issue should be resolved through the Customs department, as per the Customs Act.

    The court, considering this explanation, adjourned the hearing and asked Cosmix Engineering’s lawyer to present arguments on the case’s maintainability.

    The case involves a dispute over 22 outdoor air conditioning units and 130 indoor units, which were imported under HS Code 8415.1029, with a total value of $22,934. Customs is questioning the description of the goods and whether the correct amount of duty and taxes was paid. The Goods Declaration for these items was flagged for examination under Section 80 of the Customs Act, 1969.
